Seconda udienza preliminare 21.05.2019 – ammesse tutte le parti civili nel processo Norman Atlantic

TGR 21 maggio 2019 – Norman Atlantic, parenti vittime e sopravvissuti ammessi al processo penale

Dear Clients, on Tuesday May 21 2019 the second preliminary hearing of the criminal trial on the Norman Atlantic disaster was held in the Bitonto bunker hearingroom.

Let’s start by saying that ALL our clients were admitted as a civil party, and that this important result was by no means obvious or automatic or simple to obtain.

In fact, in the time from the previous hearing, in which we filed our request for the appearance in court, and this last hearing, the judge had assigned to the defendants an intermediate term for the filing of written memoirs with which to illustrate their exceptions and objections to the request to enter the process by passengers and family members, but also organizations and associations. Well, we can say that surely the lawyers (of Anek above all), have not been spared at all (and it must be said that they could also have done it with greater esteem and respect for the victims, as for example Costa Crociere did in the process on the sinking of the Concordia, which raised formal exceptions only against the cities and associations but not also about the constitution of a civil part of the passengers), but on the contrary they have once again (as in the civil trial) put into play every possible and imaginable procedural question, constraint of national and community legislation and of captious exception to try to prevent at any cost the request of the victims to participate in the criminal trial as parties in all aspects, and not only as spectators. Constituting as a civil party, in fact, allows the injured party from a committed crime, in addition to making a request to the judge for compensation on their damage suffered in relation to such conduct, but also play an important role as a private prosecution alongside the public one, exercised by the public prosecutor’s office, in the common search for truth and justice through the conviction of all those responsible for the disaster. Needless to say, the army of defendants’ lawyers would have preferred to have the trial without our unfriendly presence in the courtroom, and already the first heated controversy took place in the courtroom among lawyers, in a clearly nervousness due to the gravity of the charges, on one side, and the delicacy of the positions and the compensatory values ​​requested on behalf of the clients, on the other.

In their memoirs and subsequent discussion in the hearing room, the defenders of the Greek shipowner, but not only them, tried to enforce the rules of Reg. (EC) 392/2009 in the criminal trial which, as you now by know, provides (art 16, point 3 of the Athens Convention) a two-year preclusional term, which led us prudently to initiate a civil lawsuit in Bari in December 2016, thus claiming, in a very insidious way, that today it would not be possible for us to validly transfer the compensation action from the civil to the criminal trial, due to some alleged forfeiture and other (alleged) defects matured during the civil trial. Nevertheless the defendants’ defenses claimed that the nature and legitimacy of the requests was not adequately demonstrated and documented.

PRIMA UDIENZA PENALE – 06 maggio 2019

On May 6, 2019, the first preliminary hearing of the Norman Atlantic criminal case was held in the Bitonto bunker room near Bari. The large number of trial parties (public prosecutors and consultants, lawyers for the many defendants, civil lawyers and members of the harbor master’s office, ministries officies and security, as well as journalists and press) made it necessary to move the hearing to a separate branch of the Bari courthouse, which therefore on each day provided for in the calendar set by the judge, will be opened and dedicated specifically to the needs of our process. The only defendant present in the courtroom was Carlo Visentini, owner of the Norman Atlantic’s company, while no member of the crew or the Greek company decided to attend the first court hearing, despite the regularity of the notifications, and therefore the criminal trial against them will continue without any delay, in absentia.

Even among the victims no one was present, but this is obviously due to the fact that for the most part they are people living far from Bari, mainly Greece and Albania, but also because of the fact that these are the first bars of the preliminary hearing , characterized by formal procedural activity and of little substantial interest for the people who were on board the ship. Furthermore – as we expected – the families of the victims and the passengers who filed to be a civil part in the criminal trial are very few compared to the number of passengers and injured parties, but this is mainly due to the fact that most victims have concluded transactions or have acted and continue to claim damages in front of the civil court.

Our pool of lawyers, on May 6th, has instead formalized at the beginning of the hearing the request for the establishment of a civil party claim in the criminal trial, for all our clients, in this way transferring the entire claim for damages – pursuant to art. 75 Italian Criminal Procedure Code – from the civil court office directly in the criminal trial, having already filed,  as you know, a previous case within two years from the claim, in favor of all our clients and in a civil court, to avoid the possible two-year forfeiture of the right to compensation, envisaged by EC regulation 392/2009; when – on the next criminal hearing (set for May 21, 2019) – the civil action claim will be accepted and declared by the judge, this will automatically lead to the interruption of the previous civil proceeding, ritually registered to the role and pending at the Civil Court of Bari RG 20070/2016 – dott. Norman Atlantic: a maggio l’udienza preliminare – first hearing in may

Come avevamo anticipato a fine dicembre, è stata finalmente firmata la richiesta di rinvio a giudizio e fissata la prima serie di udienze preliminari nell’aula bunker di Bitonto: si parte dal 06 maggio 2019 ed è stato fissato un primo calendario di udienze; assieme al decreto di fissazione udienza GUP è stato notificata anche la richiesta di rinvio a giudizio da parte della procura di Bari, e le novità, rispetto alla prima formulazione dei capi di imputazione all’epoca delle indagini preliminari e dell’incidente probatorio, sono decisamente molte, oltre che nell’elenco di soggetti imputati, notevolmente aumentato comprendendo oggi nei 32 soggetti una buona parte dell’equipaggio, anche nei capi di imputazione, che alla luce dei risultati della perizia e degli accertamenti tecnico-scientifici, è stato ampiato e dettagliato in modo estremamente rigoroso e giuridicamente articolato.


As we anticipated at the end of December, the request for indictment was finally signed by the P.P.’s and the first series of preliminary hearings is being set up in Bitonto bunkering room: starting from May 6th, a first calendar of hearings is already set; together with the decree of the GUP hearing, the request for prosecution by the Bari PP’s office was also notified, and the news, compared to the first formulation of the indictments at the time of the preliminary investigations and the probationary incident, are decidedly many, and beyond that in the list of subjects accused, greatly increased comprising today in the 32 subjects a good part of the crew, but also in the counts of imputation, that in light of the results of the appraisal and the technical-scientific investigations, it is detailed in an extremely rigorous and juridically articulated manner.

Depositata la relazione dei periti -Expert’s report is being filed

IMG_7220NORMAN ATLANTIC criminal trial: after a long wait, it has being finally filed the report, drafted from the experts appointed by the GIP almost a year ago; it is a monumental mass of data, which we will have in our hands shortly.

Given the complexity of the investigations conducted on assignment from Bari Criminal Court, the monumental mass of electronic data annexed to the report and the heterogeneity of the various issues that were addressed into consideration from the college of experts, it was agreed to establish a few number of hearings to present the results.

The hearings will be held – March 20 and 31, and from April the 3rd to the 8th of April – in the Bunker Courtroom of Bitonto, considering the need for adequate space because of the large number of parties allegedly involved in the Trial.

As known, in the meantime we launched a 24 million euro civil action in the Court of Bari, and we are fully confident that the results of the criminal investigations will be decisive to ensure the gross negligence of Anek and Visemar in the Norman Atlantic maritime disaster, canceling the indemnity limits for passengers and victims imposed by the Athens Convention of 1974, and push this trial towards the recognition of punitive damages to be borne by the two shipping companies.


Processo penale NORMAN ATLANTIC: dopo una lunga attesa è stata finalmente depositata la perizia redatta dagli esperti nominati dal GIP quasi un anno fa; si tratta di una imponente massa di dati, che avremo a nostra disposizione a breve.

Vista la complessità delle indagini svolte su incarico del Tribunale penale di Bari, della monumentale massa di dati informatici allegati alla relazione e la eterogeneità dei vari aspetti presi in considerazione dal collegio dei periti, si è deciso di fissare un certo numero di udienze per illustrare i risultati.

Le udienze si terranno il 20 ed il 31 marzo e dal 3 all’8 aprile nell’aula Bunker di Bitonto, considerando la necessità di uno spazio adeguato per via dell’alto numero di parti presumibilmente interessate al processo.

Come noto, abbiamo nel frattempo avviato la azione civile da 24 milioni di euro presso il Tribunale di Bari, e siamo del tutto convinti che i risultati delle indagini penali saranno risolutivi per accertare la colpa grave di Anek e Visemar nel disastro marittimo del Norman Atlantic, annullando i massimali risarcitori per i passeggeri e le vittime imposti dalla Convenzione di Atene del 1974, e spingere questo processo verso il riconoscimento dei danni punitivi a carico delle due compagnie di navigazione.

Two years from the Norman Atlantic tragedy – Due anni dalla tragedia Norman Atlantic

norman-atlantic-in-fiammeExactly two years ago, on December the 28th 2014, the NORMAN ATLANTIC ferry, property of the Italian shipowner VISEMAR and rented by the Greek company ANEK LINES, departed from Greece and directed to Ancona, caught fire in the middle of the night off the Albanian coast, and in short time went drifting off the Adriatic sea, in a storm of six meters waves and force 8 wind, with almost 500 people on board and overrun with cars, trucks and Tir carrying goods from Greece to Italy, especially olive oil, which would then fuel the flames for days. The origins of the fire are still under investigation, via a procedure of recording evidence that, as required by the Public Prosecutor of Bari, will have to verify not only the evolution of the shipping incident, but also, and above all, the possible Crew responsibilities in emergency management on board, and the companies ones for malfunctions, as it seemed clear from the start, that the latter turned the fire – started from the deck 4 of the ship, in a real holocaust for dozens of people, 10 dead and over 19 missing, imprisoning the rest of the survivors on the top and outside deck of the ship, drifting inexorably and internally devoured by flames, and to be recovered only by helicopter and transferred one by one. A difficult rescue operation because of adverse weather and sea conditions, and that, despite having involved over 20 merchant and naval ships of different nationalities and several rescue helicopters, lasted for more than two days – an infinite time for those caught between the grip of toxic smokes, flames, incandescent floors and the icy cold of the water jets – sprayed continuously by emergency ships. The very few who managed to take their seats on lifeboats or reach the floating boat dropped overboard, lived an experience of terror and horror, even worse than those who remained trapped on the burning ferry.

No fire alarm was issued, no warning from the crew, and the passengers awoke at night between coulters of smoke and panic scenes. A panic which released – in many – the worst in human race. The first to abandon ship were some of the crew, dropping quickly the only usable lifeboat, with just a third of its precious capacity of persons. During the retrieve of the passengers using the baskets lowered from helicopters, others have literally attacked the rescuers, with bites and punches, just to be saved first, others refused to leave priority to women and children. Some people threw himself into the water to escape the flames, and was quickly swallowed by the waves of the icy December sea. Some bodies of drowned victims were found after days, torn apart by evident shark bites. Nearly twenty people are missing, but the count of those missing is certainly more serious, considering the presence on board of many illegal immigrants.

In the tragedy – however – there were also scenes of altruism and heroism, as in the case of the Orthodox priest who generously helped many shipwrecked persons to climb the dangerous rope ladder thrown by the rescue ship to the lifeboat on which they stood, leaving the way to all families before falling into the sea and get lost forever; or the greek doctor, who still works in Italy, which remained on board the ferry up until the end, providing his assistance to fellow sufferers, or like some truck drivers who, at great personal risk, managed to hook the towing tugs cable to the Norman Atlantic.

A horror lived in long and intense measure, in extreme psychophysical and weather conditions, which left indelible marks inside all people escaped from death, diagnosed in terms of “post-traumatic stress disorder“, studied for the first time in World War I and Vietnam veterans, and then ascertained as a psychological pathology, typical of disaster survivors, as in the case of the collapse of the twin towers.

After two years we are still waiting for the closing stage of the preliminary investigation by the magistracy and experts appointed by the Criminal Court of Bari. A report that will hopefully shed some light on the many shadows that since the beginning we have emphasized, with regard to ship-owners, the carrier, crew, those who certified the ship but also – and above all – in the maritime great transportation system, where the law of profit – too often – seems to prevail over the safety rules and accident prevention.

Richiesta la proroga indagini preliminari

PROROGA 1 E 2 NORMAN ATLANTIC_Page_02 L’ufficio del GIP ha notificato in data odierna ai difensori delle parti coinvolte l’avviso relativo alla richiesta di proroga del termine per il compimento delle indagini preliminari nell’ambito del procedimento penale sull’incendio del Norman Atlantic; La Procura di Bari, infatti, tenuto conto della necessità di attendere le risultanze della perizia disposta in ambito di incidente probatorio, le cui operazioni sono iniziate il giorno 11.06.2015 e sono tuttora in corso, volta all’accertamento dei malfunzionamenti della nave, dinamica incendio e accertamento dei fatti-reato ascritti agli indagati, nonchè la necessità di acquisire gli esiti delle perizie medico-legali, delle rogatorie internazionali e delle ulteriori investigazioni delegate alla Polizia Giudiziaria, ai sensi dell’art. 406 del codice di rito penale, ha richiesto la proroga di ulteriori sei mesi per concludere la fase di indagini preliminari.

Al via l’Incidente Probatorio per verificare nuove responsabilità Norman Atlantic

Abbiamo appena la settimana scorsa depositato l’ennesimo gruppo di querele per i passeggeri che si sono affidati al nostro pool e, come avevamo previsto, si passa alla fase ulteriore. I Pm di Bari non perdono tempo e subito dopo la chiusura dei termini di 90 gg. per il deposito delle querele, notificano la richiesta di incidente probatorio ai 12 indagati, accusati di cooperazione colposa in naufragio, omicidio plurimo e lesioni, anche al fine di accertare nuove responsabilità per il naufragio della Norman Atlantic, la motonave naufragata lo scorso 28 dicembre al largo delle coste albanesi in cui sono morte 11 persone (18 i dispersi per ora accertati). Oltre ai due legali rappresentanti della società greca Anek, noleggiatrice del traghetto, al  supercargo della società Anek  (addetto alle fasi di imbarco), all’armatore Carlo Visentini e al comandante Argilio Giacomazzi, ci sono sette membri dell’equipaggio. Fra i quesiti proposti dalla Procura c’è, inoltre, l’individuazione di «eventuali profili di responsabilità per ritardi nell’attivazione dei sistemi di allarme e antincendio» e di tutti i soggetti preposti alla sistemazione dei carichi a bordo, al controllo dei garage durante la navigazione e poi all’evacuazione dei passeggeri. Il relitto sul quale saranno eseguiti questi accertamenti è ormeggiato di fronte al terminal crociere del porto di Bari dal 14 febbraio scorso. 

Gli accertamenti

Dovrà accertare le cause dell’incendio, la gestione delle fasi di salvataggio ma soprattutto la funzionalità di tutti gli impianti a bordo della Norman Atlantic l’incidente probatorio chiesto dalla Procura di Bari nell’ambito dell’indagine sul naufragio dello scorso 28 dicembre. In particolare i pm chiedono che vengano accertati «il momento in cui la nave è diventata ingovernabile», «la causa dell’incendio, il punto dove ha avuto origine e lo sviluppo del fuoco a bordo». Occorreranno poi accertamenti sulla «presenza di sufficienti prese di alimentazione per le necessità dei mezzi imbarcati», sulla «eventuale accensione durante la navigazione dei motori dei mezzi imbarcati», sulla «presenza di materiali o carichi infiammabili sui mezzi imbarcati e la loro posizione a bordo», sulla «presenza di passeggeri all’interno dei garage durante la navigazione e durante l’incendio e la presenza di clandestini a bordo». Sulle fasi di evacuazione, la Procura vuole verificare «la correttezza dei tempi di emanazione dell’ordine di emergenza generale (raccolta e convogliamento) e dell’ordine di abbandono nave», «la correttezza delle operazioni di convogliamento e gestione passeggeri nei punti di imbarco e la gestione dei mezzi di salvataggio, lance e zattere», «la regolarità delle attrezzature di salvataggio» e «la formazione del personale deputato a fronteggiare situazioni di abbandono nave». Infine «accertare se, stanti le condizioni meteo previste, – concludono i pm – fosse necessario adottare ulteriori accorgimenti».

Ancora possibile prendere parte al procedimento penale

Nonostante il 28.03.2015 sia scaduto il termine per depositare la querela, resta sempre aperta la possibilità ed opportunità di proporre una denuncia e formalizzare la propria posizione come parti offese prendendo parte al procedimento penale che ora entra nel vivo delle fasi investigative. Invitiamo quindi quei passeggeri che siano rimasti ancora indecisi sulla strada da percorrere, a non perdere questa opportunità, che riteniamo essere la strada maestra ed immancabile attraverso la quale ottenere il risarcimento in una misura adeguata. Ricordiamo che nel caso del naufragio Concordia, i risarcimenti più alti sono stati riconosciuti ai passeggeri che hanno preso parte al processo penale, mentre chi ha scelto la strada della class action, della transazione o della causa civile, è stato fortemente penalizzato sia in termini di tempi che economici.
