The wreck of the Norman Atlantic was not to be released, says the Supreme Court, which ruled on the appeal brought by the PM of Bari, canceling without delay the decision, of last April, from the GIP dott. Francesco Agnino which accepted the request for release from seizure by the shipowner, just a few days before the opening of the preliminary hearing.
An inappropriate, untimely and highly questionable decision, as indeed we had challenged the GUP in the courtroom, which rejected also our request (and the PM’s) to maintain the seizure prudentially on the ship, in order to allow further verifications through the experts during the trial process .
The annulment from the Supreme Court, now, leaves a gap hardly recoverable, given that since July the shipowners have hastily moved the wreck from the port of Bari to be scrapped at a construction site in Turkey.
Il relitto della Norman Atlantic non andava dissequestrato, lo dice la suprema Corte di Cassazione che si è pronunciata sul ricorso proposto dai PM di Bari, annullando senza rinvio il provvedimento con il quale, nell’aprile scorso, il GIP dott. Francesco Agnino aveva accolto la istanza di dissequestro dell’armatore, ad appena pochi giorni dall’apertura dell’udienza preliminare.
Una decisione inopportuna, intempestiva e fortemente discutibile, come in effetti avevamo contestato al GUP in aula, che ha rigettato la nostra richiesta (e del PM) di mantenere il vincolo prudenzialmente sulla nave, al fine di consentire ulteriori verifiche attraverso i periti durante il processo dibattimentale.
L’annullamento della Cassazione, adesso, lascia un vuoto difficilmente recuperabile, visto che da luglio gli armatori hanno in fretta e furia spostato il relitto dal porto di Bari per essere rottamato in un cantiere in Turchia.
