The first hearing of the Norman Atlantic trial was held on February 26, 2020, in the middle of the Coronavirus emergency in Italy and the air strike of the day before, seriously jeopardizing the deferral of the meeting, as requested by many lawyers of the defendants and firmly opposed by our legal team (which represents the largest number of passengers) and lawyers from many other civil parties; in any case, the Court guaranteed the normal conduct of the hearing, also taking into account that the bunker room, where each meeting is scheduled for the moment, is a place detached from the Court of Bari and manned at the entrance by law enforcement and police.
The long call list of the defendants and defenders, of the civil parties and of the remaining offended parties not brought to trial, with the verification of the regularity of the notifications, revealed some shortcomings of the return postcards, leading to the need for a short postponement, and was followed by a preliminary organization of the next meetings (25 March, 22 April and 20 May 2020).
During the audience, the sisters of Carmine Balzano, one of the missing in the maritime disaster, were also present in the courtroom, but the turn for a presence in the courtroom of our clients is expected at the time of the testimonies on the experience lived on board the ship, to be told in courtroom or, in some cases, through a written declaration.
The next hearings will be dedicated to the discussion on the new civil lawsuits, preliminary exceptions (exception of jurisdiction Italy-Greece, exception of jurisdiction between Bari and Brindisi, exception of formal defect of the documents due to lack of translation / notification of notice 415 bis, forfeiture from the civil action for the expiry of the two-year term of the EC regulation 392/2009, expulsion request from some of the civil responsible etc. etc.), many of which have already been proposed by the defendants of the accused in the preliminary hearing phase, and widely rejected by the GUP.
According to what reported by the President of the Board of Judges, dr. Marco Guida, the calendar will have a decisive acceleration starting from June / September, entering the heart of the examination of witnesses and technical consultants.
The next meeting is therefore scheduled for March 25, 2020 in Bitonto.
in data 26 febbraio 2020 si è tenuta la prima udienza dibattimentale del processo norman Atlantic, nel pieno della emergenza Coronavirus in Italia e dello sciopero aereo del giorno prima, mettendo a serio rischio il differimento d’ufficio dell’incontro, come richiesto dai difensori degli imputati e fermamente opposto dal nostro team legale (che rappresenta il maggior numero di passeggeri) e dagli avvocati di molte altre parti civili; in ogni caso il tribunale ha garantito il normale svolgimento della udienza, anche tenuto conto che l’aula bunker dove è previsto per il momento ogni incontro, è un luogo distaccato dal tribunale di bari e presidiato all’ingresso dalle forze dell’ordine.
Il lungo appello degli imputati e difensori, delle parti civili e delle restanti parti offese non costituite in giudizio, con la verifica sulla regolarità delle notifiche, ha riscontrato alcune mancanze delle cartoline di ritorno, comportando la necessità di un rinvio, ed è stato seguito da una breve organizzazione dei prossimi incontri (25 marzo, 22 aprile e 20 maggio 2020).
In aula durante l’udienza erano presenti anche le sorelle di Carmine Balzano, uno dei dispersi nela disastro marittimo, ma il turno per una presenza in aula dei nostri clienti è previsto al momento delle testimonianze sulla loro esperienza a bordo della nave, da raccontare in aula ai giudici o, in alcuni casi, attraverso una dichiarazione scritta.
Le prossime udienze saranno dedicate alla discussione sulle nuove costituzioni di parte civile, eccezioni preliminari (eccezione di giurisdizione Italia-Grecia, eccezione di competenza tra Bari e Brindisi, eccezione di vizio formale degli atti per mancata traduzione/notifica dell’avviso 415 bis, decadenza dall’azione civile per decorrenza del termine biennale del regolamento CE 392/2009, estromissione delle responsabili civili etc. etc.), molte delle quali sono state già proposte dai difensori degli imputati nella fase di udienza preliminare, e ampiamente respinte dal GUP.
Stando a quanto riferito dal Presidente del Collegio giudicante, dott. Marco Guida, il calendario avrà una decisiva accelerazione a partire da giugno/settembre, entrando nel vivo dell’esame dei testimoni e consulenti tecnici.
Il prossimo incontro quindi è fissato per il giorno 25 marzo 2020 a Bitonto.
